Terms of Service

1. Acceptance of Terms

By creating an account, accepting a team invitation, downloading the Race Chief AI application, or using any part of the Service (as defined below), you (“Member”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service.

Accepting a team invitation constitutes agreement to these Terms. When you join a team through an email invitation link, you acknowledge that you have read, understood, and agreed to these Terms before your account is created.

2. The Service

Race Chief AI provides a software platform for short track oval racing teams, including:

• Session logging, lap timing, and race data recording
• Setup sheet management and version tracking
• Tire temperature analysis and pyrometer data logging
• Pre and post-session team checklists
• Live weather integration
• Virtual Crew Chief AI (Pro and Elite plans) — AI-generated setup recommendations powered by Google Gemini
• Team member management and role-based access

3. Member Agreement & Team Accounts

Race Chief AI operates on a team-based model. All race data, sessions, setups, and communications within the Service are associated with a team account.

• Team Owner: The person who creates a team account is the Team Owner. The Owner controls billing, member access, and data ownership.
• Invited Members: Persons invited by the Team Owner join as team members with a specific role. Members operate under the authority and subscription of the Team Owner.
• Data ownership: Race data entered into the Service is owned by the team account (Team Owner). If a member is removed from a team, their account data remains associated with the team.
• Roles: Members are assigned roles (Driver, Crew Chief, Engineer, Tire Man, Spotter, Data/Timing, Crew) that determine their access within the app. Role assignments are at the sole discretion of the Team Owner.

4. Subscriptions and Billing

• Free Trial: New team accounts receive a 7-day free trial at the Elite tier. No credit card is required to start a trial. At the end of the trial, the account is downgraded to the Free tier unless a paid plan is selected.
• Paid Plans: Basic ($9.99/mo), Pro ($12.99/mo), Elite ($29.99/mo). Prices are in USD and billed monthly. Annual billing may be offered at a discount.
• Mobile Subscriptions: In-app purchases on iOS and Android are processed through Apple App Store / Google Play via RevenueCat. Refunds are subject to Apple’s and Google’s respective refund policies.
• Desktop Subscriptions: Subscriptions on macOS and Windows desktop apps are processed through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period.
• Car Limits: Basic and Pro plans are limited to 1 car. Elite plans are limited to 3 cars.
• Seat Limits: Basic and Pro plans are limited to 5 team seats. Elite plans are limited to 15 seats.

5. AI-Generated Content Disclaimer

The Virtual Crew Chief feature provides AI-generated setup recommendations. These recommendations are for informational purposes only. Race Chief AI makes no warranty, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any AI-generated recommendation.

By using the Virtual Crew Chief feature, you acknowledge:

• AI recommendations do not replace the judgment of a qualified crew chief or racing engineer
• All vehicle modifications are made at your own risk
• Race Chief AI is not liable for any vehicle damage, race incident, injury, or financial loss arising from following AI-generated recommendations
• It is your responsibility to verify that any setup change complies with applicable racing series rules and safety regulations

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Share your account credentials with persons outside your team
• Attempt to reverse engineer, decompile, or extract source code from the application
• Use automated tools to scrape or bulk-extract data from the Service
• Attempt to circumvent subscription plan limits or billing systems
• Upload false, misleading, or fabricated race data
• Harass, abuse, or threaten other team members through the Service

7. Intellectual Property

Race Chief AI and its logos, designs, software code, and content are the intellectual property of Race Chief AI. You are granted a limited, non-exclusive, non-transferable license to use the Service for your team’s racing operations.

Your race data (lap times, setup sheets, session notes, etc.) remains your property. You grant Race Chief AI a license to store, process, and transmit this data solely for the purpose of providing the Service.

8. Termination

You may cancel your subscription and delete your account at any time from within the app. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service. Upon termination, your data will be deleted in accordance with our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Race Chief AI and its owners, officers, and developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of race data, loss of winnings, vehicle damage, or personal injury, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy of any AI-generated content.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association’s rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
